Wyoming Does Not Require Gap Insurance

Wyoming law does not require gap insurance. The state mandates liability coverage only: $25,000 per person for bodily injury, $50,000 per accident for bodily injury, and $20,000 for property damage. Gap insurance is not part of that minimum requirement, and you will not be cited for driving without it.

The confusion arises because lenders and lessors impose their own requirements. When you finance or lease a vehicle, the contract almost always requires gap insurance until the loan balance drops below the vehicle's actual cash value. That requirement comes from the lender, not the state. Wyoming law gives lenders the authority to mandate coverage that protects their collateral, and gap insurance is one of those coverages.

When Lenders Require Gap Insurance

Lenders require gap insurance when the loan balance exceeds the vehicle's actual cash value. This condition is most common in the first two to three years of a loan, when depreciation outpaces principal reduction. A new vehicle loses 20 to 30 percent of its value in the first year, while your loan balance drops by only the amount of principal you pay down. The gap between what you owe and what the vehicle is worth creates the lender's exposure.

The lender's requirement appears in the finance agreement, not in Wyoming statute. If you drop gap insurance before that threshold is met, the lender can force-place coverage and charge you for it, or declare the loan in default.

When you insure multiple vehicles on one policy, the lender's requirement applies only to the financed vehicle. Your other vehicles do not need gap insurance unless they are also financed and the lender requires it. Each vehicle's gap insurance requirement is independent of the others.

The lender's gap insurance requirement is contractual, not statutory. Wyoming law does not require it, but your finance agreement does.

How Gap Insurance Works Across Multiple Vehicles

When you add a financed vehicle to a policy that already covers other cars, the gap insurance requirement applies only to the financed vehicle. The coverage does not extend to the other vehicles unless they are also financed and the lender requires it.

Gap insurance is vehicle-specific. It pays the difference between the actual cash value of the totaled vehicle and the outstanding loan balance on that vehicle. If you have three vehicles on one policy and only one is financed, only that vehicle needs gap insurance. The other two vehicles do not benefit from gap insurance because there is no loan balance to cover.

Most carriers allow you to add gap insurance to one vehicle on a multi-car policy without adding it to the others. The premium for gap insurance is calculated per vehicle, not per policy. Adding gap insurance to one financed vehicle does not increase the premium for the other vehicles on the policy. When the financed vehicle is paid off, you can drop gap insurance on that vehicle without affecting coverage on the others.

When You Can Drop Gap Insurance

You can drop gap insurance when the loan balance falls below the vehicle's actual cash value. At that point, collision and comprehensive coverage are sufficient to pay off the loan if the vehicle is totaled. The lender no longer has exposure, and the contractual requirement ends.

Most lenders do not notify you when you reach that threshold. You must track the loan balance and the vehicle's value yourself. Check your loan balance on your lender's website or monthly statement. Check the vehicle's actual cash value using Kelley Blue Book, NADA Guides, or a similar valuation tool. When the loan balance is lower than the actual cash value, contact your lender to confirm that gap insurance is no longer required, then contact your carrier to drop it.

Dropping gap insurance mid-term reduces your premium immediately. The carrier will prorate the refund for the unused portion of the term. If you have multiple vehicles on the policy, dropping gap insurance on one vehicle does not affect the premium for the others.

The lender owns the vehicle, and the lease payment covers depreciation plus interest. If the vehicle is totaled, the lender expects to recover the full residual value, not the depreciated actual cash value.

Some lease agreements include gap insurance in the lease payment. Others require you to purchase it separately through your auto insurance carrier. Read the lease agreement carefully to determine whether gap insurance is included or whether you must add it to your policy. If the lease includes gap insurance, you do not need to add it to your auto policy. If the lease does not include it, the lender will require proof that you have added it before you drive the vehicle off the lot.
